Legal Issues Pertaining to Sweeping

NLRB Issues Final Rule Regarding Employee Rights Notification

The National Labor Relations Board (NLRB) has issued a Final Rule requiring most private-sector employers to notify employees of their rights under the National Labor Relations Act (NLRA).

The rule mandates, among other things, that employers post an 11 x 17 inch notice in conspicuous places where they are readily seen by employees. Employers must also post the required notice on an intranet or internet site if personnel policies and rules are customarily posted there.

The rule will take effect on November 14, 2011. The attached client alert describes the rule in more detail. Employers are encouraged to review the attached alert, and to consider taking the following steps now:

  • Obtain a copy of the notice from the NLRB website: http://www.nlrb.gov/poster
  • Post the notice in a conspicuous location, where other workplace notices are posted.
  • Editor's Note: We recommend you also take a look at the Frequently Asked Questions (FAQ) section of the NLRB website where the poster is located.
  • Post the notice on the company intranet or internet site, if personnel policies and rules are customarily posted there.
  • Translate the notice, if necessary.
  • Educate managers and supervisors about NLRA do's and don'ts, and strategies for maintaining a positive, respectful workplace where morale is high, employees have a voice, and employees do not feel the need to turn to a union or the NLRB to be treated in a fair and legally compliant manner.
